Terms of Service

These terms apply to your use of KubeSpend, including the console at console.kubespend.io, the KubeSpend API, and the KubeSpend agents ("the service"). By creating an account or using the service you agree to them on behalf of yourself and the organization you use it for. If you have a separate written agreement with us, that agreement takes precedence.

1. Accounts

You must give a valid email address you control and keep your sign-in codes, sessions and API keys secure. You are responsible for activity under your account and your organization's API keys. Tell us promptly at connect@kubespend.io if you believe a credential has been compromised, and revoke the affected API keys in the console.

2. Early access and free trial

KubeSpend is in early access. Free and trial use is subject to the usage allowance and cluster limit shown in the console. Features may change or be withdrawn, and early-access features may be less reliable than generally available ones. Paid plans, where offered, are governed by the pricing and order terms agreed at the time.

3. Your data

You keep all rights to the data your agents send and the information you enter ("your data"). You give us permission to process your data only to provide, secure and support the service, as described in our Privacy Policy. You are responsible for having the right to install the agents in the clusters you connect and to send us the data they collect.

4. Acceptable use

You must not:

  • use the service to break the law or infringe anyone's rights;
  • try to access another customer's data, or probe, scan or test the service's security without our written permission;
  • send data designed to disrupt the service, or exceed rate limits or quotas by circumventing them;
  • use the sign-in, invitation or support features to send unsolicited email to people who did not ask for it;
  • resell the service, or copy it to build a competing product.

We may suspend access that breaks these rules or puts the service or other customers at risk, and will tell you why unless the law prevents it.

5. Recommendations

Cost figures are calculated from public cloud list prices and the data your agents send, and recommendations are estimates. They are not a guarantee of savings or of how your workloads will behave after a change. Review every recommendation before applying it to a production system.

6. Availability and changes

We work to keep the service available but do not guarantee it will be uninterrupted or error-free. We may change the service, and will give reasonable notice of changes that materially reduce what it does for you.

7. Ending your use

You can stop using the service at any time by uninstalling the agents and asking us to close your account. We may end these terms if you materially breach them. When an account is closed we delete your data as described in the Privacy Policy.

8. Disclaimers and liability

To the extent the law allows, the service is provided "as is", without warranties of any kind, and we are not liable for indirect or consequential losses, or for loss of profits, revenue or data. Our total liability arising from the service is limited to the amount you paid us for it in the twelve months before the claim, or one hundred US dollars if you paid nothing. Nothing in these terms limits liability that cannot be limited by law.

9. Changes to these terms

We may update these terms. We will change the date above and, for significant changes, notify account owners by email before they take effect. Continuing to use the service after that means you accept the updated terms.

10. Governing law

These terms are governed by the laws of India.
